KARIOS MARKETS LIMITED (hereinafter called “the Company”) is an investment dealer registered and licensed in the Republic of Comoros Union and authorized and regulated under INTERNATIONAL BROKERAGE and CLEARING HOUSE LICENSE, IBC REGULATION ACT 2014 company registration number HA00824763 and license number BFX2024166 at Bonovo Road, Fomboni, Island of Moheli, Comoros Union (the “Licence”).

The Company is committed to protecting the privacy and security of the Personal Data (as defined below) of its Data Subjects (“Data Subject” or “you”) in accordance with the Data Protection Act 2017 of Comoros Union and other applicable laws and regulations (together referred to as the “Laws”).
This Privacy Notice (“the Privacy Notice”) outlines how we collect, use and protect your data when you visit our website, in accordance with the Laws.
From time to time, we may update this Privacy Notice and our Data Protection Policy (“the Data Protection Policy”), and will notify you of these changes by posting the updated terms on our website www.kariosmarkets.com.
By using our services, you agree to the terms of this Privacy Notice and our Data Protection Policy, as provided in Annex A, and your continued use of the services constitutes your ongoing agreement to these documents.
2. Collection of your Personal Data
Personal Data refers to any information about an identified or identifiable individual as construed by the Laws (hereinafter referred to as “Personal Data”).
As part of providing our services, or information about our services, to you, and to ensure we do this in a compliant way, under the authorization of our regulator and the Laws, we must collect Personal Data from Data Subjects which include our clients, potential clients, visitors to our website and service providers or suppliers. This may include third parties carrying out credit or identity checks on our behalf.
When you enquire or apply to open an account or when you maintain an account with us, or request a service, we will require you to provide us with certain information about you. We will need to process the
information to verify your identity, to determine how we should classify you as a client, to determine whether financial trading is appropriate for you, to respond to your requests and to process your transactions. We may need to use your Personal Data to comply with applicable laws, court order or other judicial process, or the requirements of any applicable regulatory authority.
Personal Data will generally be collected directly from you through our application process, account opening forms and other communications with you. We will only use the Personal Data as set out in this Privacy Notice, Data Protection Policy and the Terms of Business of the Company (the “Terms of Business”).
We will not collect your sensitive Personal Data without your consent unless so provided by the Laws. These exceptions include if the collection is required to pursue our legitimate business activity subject to appropriate safeguards or the processing is necessary for the establishment, exercise or defense of a legal claim or as may be otherwise allowed under Laws;
We may collect Personal Data about you from a third party or parties or share information with a third party, such as identity verification services, regulators, an introducing broker, marketing agencies, online vendors and service providers.
We may collect your name and contact details (such as your email address, phone number or address) in order to send you information about our products and services which you might have expressed interest in and have consented to such marketing advertisement. We may collect this directly from you, or through a third party. If a third party collected your name and contact details, they will only pass those details to us for marketing purposes if you have consented to them doing so. It is in our legitimate interest to use your personal information in such a way. Our web pages and emails may contain cookies and other similar types of data analysis tools which allow us to track receipt of correspondence and to count the number of users that have visited our webpage or who have opened our correspondence. We do not knowingly collect personal data from children or other persons who are under eighteen (18) years old. If you are under eighteen (18) years old, you may not submit any personal data to us or subscribe for our services.
3. Personal Data Collected
We may collect the following categories of Personal Data from actual or potential customers:
Your full name, address, residence, nationality, identity number and contact information, including but not limited to phone number email address, and language preferences;
Your date of birth, gender, and biometrical data;
Your professional and employment details;
Your identification details such as your passport or driver’s license;
Proof of address such as a bank statement or utility bill;
Your tax identification number;
Information about your employment, income and the source of your funds and wealth, including details about your assets and liabilities;
Your trading experience and transaction history, interest in investment products.
We obtain this information through your use of our services or our websites, the account opening application and from information provided in the course of ongoing customer communication
When you interact with our services, our servers keep an activity log unique to you that collects certain administrative and traffic information including: the source of your IP address, the time of access, the date of access and the web pages you visited. We need this information to provide you with our services.
We are required to collect information about visitors to our premises. We may record Personal Data if you visit us such as your name, the date and time you arrived and left, who you are visiting, your firm or employer name and your contact details.
We may record any communications, email, electronic, by telephone, in person or otherwise, that we have with you in relation to the services we provide to you and our relationship with you. These recordings will be our sole property and constitute evidence of the communications between us. Any telephone conversation may be recorded without the use of a warning tone or any other further notice.
4. Retention Period
We retain your Personal Data only for as long as necessary to fulfill the purposes for which it was collected and to comply with legal, regulatory requirements and in accordance with our internal policies which establish general standards and procedures regarding the retention, handling and disposition of your personal information. When we consider that Personal Data is no longer needed, we will remove any Personal Data related to you and we will securely destroy the records.
If you have an account with us, we will keep your Personal Data for the period you have an account and a further seven (7) years from the end of our relationship in accordance with anti-money laundering laws and for our legitimate business interests in maintaining contractual records. Otherwise, we will not keep your Personal Data for any longer period except where necessary in case of any claim or as necessary to comply with legal, regulatory, accounting or reporting requirements. When it is no longer required, your Personal Data will be deleted or destroyed.
5. Transfer of Personal Data
We may pass your Personal Data on to our affiliates and third-party service providers contracted to the Company in the course of dealing with you.
We will take all the necessary steps to ensure that our arrangements with third-party service providers and online vendors protect your Personal Data in accordance with the Laws and that any such party is subject to the Laws or equivalent legislations. Any Personal Data will only be disclosed to third parties in accordance with our Data Protection Policy and our Terms of Business. We will not sell, lend or rent your Personal Data.
We may on occasion need to transfer some of your information to other group companies or service providers in countries in or outside Comoros Union. This may happen if our servers or suppliers and service providers are located elsewhere i.e. the EEA (European Economic Area). When we transfer your Personal Data outside Comoros Union, we will ensure the data recipient is subject to the same or equivalent data requirements under the Laws or the data transfer is subject to protective measures outlined in the Laws. By using our services and providing us with your information, you consent to the collection, transfer, storage and processing of your Personal Data outside of Comoros Union.
6. Security of Your Information
We implement appropriate security measures to protect your Personal Data from unauthorized access, alteration, or disclosure. These measures are in line with the requirement of the Laws and best industry practices, However, no method of transmission over the internet is entirely secure, and we cannot guarantee absolute security.
7. Your Rights
The Company is a data controller as construed by local data protection laws and you have the following rights with respect to your Personal Data, with the exception of certain circumstances, in accordance with local and relevant laws.
Right to access, rectify, restrict or erase your Personal Data including the right to receive Personal Data you have provided to us upon a written request. This right also includes the right to supplement or update existing Personal Data provided to us.
Right to object to processing of Personal Data.
Right to prevent automated profiling (note that we do not engage in automated profiling and will not make any decisions based on the automated processing of Personal Data).
Right to withdraw consent to process your Personal Data at any time, without affecting the lawfulness of processing.

8. Concerns or complaints

We will respond and address, without delay, any request, question, complaint or enquiry you have about your personal information or our conduct in processing it.
